Purchase of products

Price and Payment Terms

Although we strive for accurate pricing on our web store, occasional errors may occur. If we identify a price error for any product(s) you have ordered, we will promptly inform you and provide the choice to confirm the order at the correct price or cancel it.
We are not obligated to sell product(s) at incorrect (lower) prices, even after sending an Order Confirmation, if the pricing error is an obvious typographical or mathematical mistake that a reasonable person would recognize.
We reserve the right to refuse orders for bulk or high-value purchases and to change price and availability information without prior notice.
We may notify you, before accepting your order, of any price revisions due to changes in the cost of the products, including but not limited to changes in tax rates, levies, exchange rates, or changes to product descriptions. If you choose to proceed with your order, you acknowledge and agree to purchase the product at the revised price and/or description.

These limitations shall also apply in the event that any warranty or remedy provided under this Agreement fails of its essential purpose. Please note that in some jurisdictions, the exclusion or limitation of incidental or consequential damages or other mentioned limitations may not be applicable to you.You may not offset any payment by way of counterclaim or set-off without our prior written consent. We are not liable for billing errors unless you report such errors within fifteen (15) working days from the date of acceptance. If the billing error is solely our responsibility, we will cancel your order and refund any prior payment made for that product. We will also allow you to place a new order for the product.

Without prejudice to the foregoing and to the maximum extent permitted by law, we shall have no liability to you if the products infringe or are alleged to infringe any rights (including intellectual property rights) of any third party.

Licenses & Export Laws

The purchaser is responsible for obtaining any necessary licenses or consents from government authorities or other relevant authorities at your own expense, as required for the purchase, transportation, or use of the products. You agree to provide evidence of such licenses or consents upon our request.
The purchaser agrees to comply with any applicable export control laws or regulations related to the purchase, transportation, or use of the products.

In such an event, Hawksbill Gaming may choose to cancel your order and refund any payments made.
SEVERABILITY – If any provision of these Terms of Sale is held by a court or other competent authority to be invalid, unenforceable, or illegal, the other provisions shall remain in full force and effect.
ASSIGNMENT – Hawksbill Gaming may assign or transfer its rights and obligations under these Terms of Sale to a third party without your consent. You may not assign or transfer your rights and obligations under these Terms of Sale without the prior written consent of Hawksbill Gaming.
WAIVER – No failure or delay by Hawksbill Gaming in exercising any right, power, or privilege under these Terms of Sale shall operate as a waiver of such right or acceptance of any variation of these Terms of Sale, nor shall any single or partial exercise by Hawksbill Gaming of any right, power, or privilege preclude any further exercise of that right or the exercise of any other right, power, or privilege. The rights and remedies provided in these Terms of Sale are cumulative and not exclusive of any rights or remedies provided by law.
