Limitation of Liability

In no event shall Hawksbill Gaming, its officers, directors, employees, or agents be liable for any special, incidental, indirect, consequential, or punitive damages, including those arising from loss of use, data, or profits, regardless of the theory of liability, arising out of or in connection with these Terms of Sale. This applies even if Hawksbill Gaming has been advised of the possibility of such damages. The maximum liability of Hawksbill Gaming (whether for breach of contract, tort, or any other legal theory) shall not exceed the amount paid by you for the Product most closely related to your damages. These limitations shall also apply in the event that any warranty or remedy provided under this Agreement fails of its essential purpose. Please note that in some jurisdictions, the exclusion or limitation of incidental or consequential damages or other mentioned limitations may not be applicable to you.You may not offset any payment by way of counterclaim or set-off without our prior written consent. We are not liable for billing errors unless you report such errors within fifteen (15) working days from the date of acceptance. If the billing error is solely our responsibility, we will cancel your order and refund any prior payment made for that product. We will also allow you to place a new order for the product.

Without prejudice to the foregoing and to the maximum extent permitted by law, we shall have no liability to you if the products infringe or are alleged to infringe any rights (including intellectual property rights) of any third party.
